Draft: pending attorney review
These terms, privacy policy and disclosures are a working draft. They have not been reviewed by an attorney and will be updated before HVACScale accepts leads or payments.
Terms, privacy and disclosures
How HVACScale works, what it is and is not, and how we handle the information you give us. These terms apply to everyone who uses hvacscale.com: people who submit a request and the contractors that buy leads.
Key disclosures
What HVACScale is and is not
HVACScale is a lead-matching and advertising service, not an HVAC contractor. Participating contractors are independent businesses responsible for their own licensing, insurance and work; confirm a contractor's license before you hire. Cost ranges are estimates, not quotes, and no price is guaranteed. Rebates of up to a stated amount may be available depending on your utility, home and income; a participating contractor confirms eligibility and we do not administer any program. This is an advertisement.
How we are paid
Participating contractors pay HVACScale a flat fee for each lead delivered. The fee is the same whether or not the contractor contacts the homeowner, books the work or wins the matter. HVACScale does not receive any share or percentage of a contractor's fees or revenue.
For contractors: compliance
HVACScale is a marketing and lead-generation company, not a contractor and not a referral guarantee. We never state that a contractor is licensed unless its license number has been verified for the state, and we never promise a price, a rebate or a tax credit. Contractors are independent, are responsible for their own state and local licensing (for example NYC DCWP home improvement, NJ master HVACR) and EPA 608 certification, and set their own quotes. Our fee is a flat price per lead that does not depend on whether a job is booked, quoted or won. Every lead carries a stored consent record naming the contractor.
No promises about outcomes
Submitting a form does not guarantee that any contractor will contact you or accept your request, and nothing on this site is a promise or prediction of any result, price or outcome.
For homeowners submitting a request
What happens when you submit the form
Our request form asks a few questions about your home and your heating or cooling system (the problem or project, system type and age, whether you own the home, timeline) and how to reach you.
If your answers fit what participating contractors have asked us for, and you have agreed to be contacted, we send your answers and contact details to a participating contractor. That company may then call, text or email you to offer an estimate. You are never obligated to speak with or hire the contractor.
HVACScale does not perform HVAC work, does not endorse any contractor and does not guarantee any price, quote or result. Any agreement for work is directly between you and the contractor.
Consent to be contacted (calls, texts and email)
The form includes a separate checkbox, unchecked by default, where you can agree to be contacted. The wording is:
By checking this box I agree to be contacted by a participating contractor at the phone number and email I provided, by phone, text message and email, including through automated technology, artificial or prerecorded voice and AI-assisted calls, about my HVAC request. Consent is not a condition of any purchase. Message and data rates may apply. Reply STOP to opt out.
We keep a record of the exact consent language you agreed to and the date and time you agreed, and we share that record with the participating contractor. You can withdraw consent by telling the contractor that contacts you or by emailing nicholas@hellonavigo.com.
States we serve
HVACScale currently operates in NY and NJ, and may add other states where this kind of marketing is clearly permitted.
For participating contractors
Nature of the service
HVACScale provides advertising and lead-generation services. Each lead is a homeowner who completed our request form and agreed to be contacted by a participating contractor. HVACScale does not perform or supervise HVAC work and does not recommend a particular contractor to any homeowner.
Fees
Contractors pay a flat fee per delivered lead, up to a monthly budget the contractor sets. Fees are not contingent on whether an estimate is booked or a job is won, and HVACScale receives no portion of any job revenue.
Contractor responsibility
Each participating contractor is responsible for holding the licenses and insurance its work requires, for its own estimates, pricing, rebate and financing statements, and for compliance with home improvement, consumer protection and telemarketing and messaging laws when it contacts a lead.
Credits
Flag a lead within 3 days if it is a duplicate, has a wrong or disconnected number, the person denies submitting, is not the owner or authorized by the owner, is a commercial property outside your offer, or is outside your service area, and we credit it. Unused budget rolls over.
Exclusivity and use of leads
Each lead is delivered to one participating contractor and is not resold to another. A contractor may use a lead only to contact that person about the request they made, within the scope of the consent the person gave.
Terms of service
By using this website you agree to these terms. If you do not agree, please do not use the site.
You agree to provide true and accurate information, to submit a form only about your own request (or one you are authorized to make), and to use your own phone number and email address.
The site and its content are provided "as is" and "as available". HVACScale makes no warranties about the accuracy or completeness of the content and is not responsible for the acts, omissions or advice of any participating contractor.
HVACScale may change, suspend or discontinue the site, or update these terms, at any time. The date of the latest version will be shown on this page once it is finalized.
Privacy policy
Information we collect
When you submit a request form we collect your answers to the screening questions, your name, phone number, email address, best time to call, and a record of your consent (the exact consent text and when you agreed). We also collect basic technical data such as IP address, browser type and pages visited.
When a contractor contacts us or applies, we collect business contact details and the billing information needed to provide the service.
How we share information
We share the information you submit only with the participating contractor you agreed to be contacted by. We do not sell your information to anyone else, and we do not share it with other contractors. We use service providers (for example hosting, database and email delivery) that process information on our behalf under confidentiality obligations, and we may disclose information when required by law.
Cookies, pixels and analytics
This site sets only the cookies needed to run it and to keep signed-in users signed in. We do not send your answers to advertising or analytics platforms.
Retention, access and deletion
We keep request records and consent records for as long as needed to provide the service and to show that consent was given, and then delete them. You can ask us to access, correct or delete your information, or to stop contacting you, by emailing nicholas@hellonavigo.com. Once a lead has been delivered, the contractor holds its own copy and handles it under its own privacy obligations.
